Hundreds of Millions Recovered. Hundreds of Cases Tried.

RileyCate, LLC was founded in Fishers, Indiana to give individuals, families, and small businesses the kind of representation usually reserved for large corporate clients. We handle plaintiffs’ personal injury and complex litigation, business and real estate disputes, criminal defense, and appeals, and we serve as local counsel for out-of-state attorneys with matters pending in Indiana courts.

What connects all of it is how we prepare. Will Riley and Russell Cate have spent their careers building cases as though they are headed to trial, because that posture is what gets insurance companies, opposing businesses, and prosecutors to take a matter seriously. We have taken hundreds of cases to trial and maintain a 90% success rate, and we have recovered hundreds of millions of dollars for our clients along the way.

Will and Russell personally oversee every matter the firm takes on, staffing it with the attorneys, associates, and staff the case calls for based on its size and complexity. You work with people who know the facts of your case, not a rotating cast of case managers.

Personal Injury

When someone else’s carelessness leaves you hurt, Indiana law gives you a path to recover what you have lost. We handle car, truck, and motorcycle accidents, rideshare and pedestrian collisions, bicycle accidents, slip and fall and premises liability, product liability, medical malpractice, pharmaceutical litigation, dog bites, brain injury, child injury, and wrongful death claims. Indiana generally gives you two years from the date of injury to file, and some claims carry far shorter notice deadlines, so the sooner we hear from you the more we can do. We take personal injury cases on a contingency fee basis, and the initial consultation is free.

Business Litigation

Running a business means eventually running into a dispute you did not see coming. A vendor stops delivering. A partner stops agreeing. A competitor crosses a line. We handle commercial litigation, shareholder disputes, LLC dissolution, contract disputes and breach of contract, non-compete compliance, and separation of partners for companies across a range of industries. We also offer alternatives to the standard billable hour, including fixed fee, contingency, and blended arrangements, so we share in the risk of litigation rather than billing by the hour regardless of outcome.

Construction Litigation

Construction projects involve more moving parts than almost any other business relationship. Owners, general contractors, subcontractors, suppliers, architects, and sureties are connected by a web of contracts, and a problem with one piece of that chain quickly affects everyone else. We handle mechanic’s liens, construction contract disputes, construction defects, payment disputes, delay and disruption claims, and performance and payment bond claims for contractors, developers, and property owners. Indiana’s mechanic’s lien statute and its statute of repose both carry deadlines that can quietly close off a claim, so it helps to call early.

Real Estate Litigation

A real estate dispute can put a property, a deal, or a business relationship on hold, and the longer it takes to resolve, the more it costs everyone involved. We represent business owners, developers, and property investors in boundary and easement disputes, breach of purchase and sale agreements, title and quiet title actions, commercial lease disputes, and adverse possession claims on both sides. Our construction practice covers mechanic’s liens, construction contract disputes and defects, payment disputes, delay and disruption claims, and performance and payment bond claims.

Appeals

Losing at trial does not always mean the case is over. If the trial court made a legal error, misapplied the law, or reached a decision the evidence does not support, you can ask a higher court to review it. A Notice of Appeal generally must be filed within 30 days of final judgment, and missing that deadline usually forfeits the right to appeal altogether. Will Riley and Russell Cate have both argued before the Indiana Court of Appeals and the Indiana Supreme Court, so that appellate depth is already in house rather than outsourced. We handle both civil and criminal appeals.

Criminal Defense

Being charged with a crime affects more than the immediate legal proceedings. It affects your job, your reputation, and your future. We represent individuals facing misdemeanor and felony charges in Indiana, from the initial hearing through trial, plea negotiations, and sentencing, including OWI and DUI charges. We also handle expungement for people who want an old conviction or an arrest that never led to a conviction sealed. The decisions made in the first days after an arrest shape everything that follows, so reaching out early matters.

Family Law

Few legal matters feel as personal as the ones that involve your marriage, your children, and the life you’ve built, and the decisions made during a family law case can shape your finances and your relationships for years to come. Family law covers the legal issues that arise when families change, including divorce (formally called dissolution of marriage in Indiana), legal separation, child custody and parenting time, child support, spousal maintenance, division of marital property and debt, paternity, and the modification or enforcement of existing orders.

Local Counsel Services

We serve as local counsel for out-of-state attorneys handling cases in Indiana state and federal courts. We associate under Indiana Admission and Discipline Rule 3(2), review and co-sign filings, appear when a court requires it, and stay engaged for as long as the matter is active. We regularly serve in Marion, Hamilton, Boone, Hendricks, Tipton, Hancock, Madison, Delaware, Bartholomew, and Monroe counties, as well as the U.S. District Court for the Southern District of Indiana. You work directly with Will or Russell, not a first-year associate who signs where they are told.
