Drug Trafficking Attorney in Indianapolis, IN

A drug trafficking investigation is usually months in the making by the time charges are filed, with wiretaps, informants, surveillance, and seized phones already in the government’s hands. Drug trafficking generally refers to large-scale distribution, including moving significant quantities of drugs, supplying other sellers, transporting drugs across state lines, or taking part in a distribution network. These cases can be charged in Indiana state court as high-level dealing, or in federal court, where the penalties are often much more severe.

Indiana law doesn’t use the word trafficking for drug sales. Instead, the state charges large-scale cases as dealing, and the highest levels apply to larger amounts. Dealing 10 grams or more of cocaine, methamphetamine, or a narcotic drug like heroin or fentanyl is generally a Level 2 felony, carrying 10 to 30 years, and dealing 10 pounds or more of marijuana is a Level 5 felony. Federal law treats trafficking even more harshly. Under federal statutes, possession with intent to distribute certain amounts triggers mandatory minimum sentences, including five years for 40 grams of a fentanyl mixture, 100 grams of a heroin mixture, or 500 grams of a cocaine mixture, and ten years for ten times those amounts. A prior serious drug conviction can increase those minimums further.

Many trafficking cases are charged as conspiracies, which means a person can be held responsible for drug quantities they never personally handled, as long as the government can tie them to the agreement. That makes it critical to examine exactly what the evidence shows about each person’s role. The defense often focuses on how wiretaps and search warrants were obtained, whether phone extractions and location data were collected lawfully, the credibility of cooperating witnesses who are trying to reduce their own sentences, and whether drug weights attributed to a defendant are actually supported. Trafficking cases also commonly involve civil or criminal forfeiture, where the government seeks to take cash, vehicles, or property it claims are connected to drug activity.

At RileyCate, we defend state and federal trafficking cases, including conspiracy charges, cases built on wiretaps and cooperating witnesses, and cases involving asset forfeiture. In federal court, outcomes are shaped by the sentencing guidelines and by relief options like the safety valve, which can allow a sentence below the mandatory minimum for qualifying defendants. For smaller cases, our Drug Dealing page explains how Indiana grades dealing charges, and our Drug Charges page covers the full range of drug offenses.

Trafficking cases put people up against well-funded investigations and long mandatory sentences, which is exactly when trial-tested defense attorneys matter most. Will Riley and Russell Cate lead our criminal defense team. Russell Cate has more than 19 years of experience and has been selected as a Super Lawyer since 2013, and Will Riley’s Super Lawyers, Top 100 Trial Lawyers, and AV Preeminent recognition reflects the kind of trial-tested credibility that carries weight with prosecutors and judges alike. About RileyCate

It can be either. Indiana charges large-scale drug sales as high-level dealing, while federal prosecutors can bring trafficking and conspiracy charges when a case involves large quantities, multiple states, or a federal agency like the DEA. Federal cases generally carry stricter sentencing rules. An attorney can help you understand which system your case is in and what that means for your defense.
Federal law sets mandatory minimum sentences based on drug type and weight. For example, 40 grams of a fentanyl mixture, 100 grams of a heroin mixture, or 500 grams of a cocaine mixture generally carries at least five years, and ten times those amounts carries at least ten years. Prior serious drug convictions can increase the minimum. An attorney can help you understand the exposure in your specific case.
The safety valve is a provision that allows a federal judge to sentence below a mandatory minimum for certain drug defendants who meet specific requirements, including a limited criminal history, no violence or weapon involvement, no leadership role, and truthful disclosure to the government. It can make a difference of years. An attorney can help you understand whether you may qualify and how to protect that option.
Yes. A drug conspiracy charge is based on an agreement to distribute drugs, so a person can be charged without ever handling them. In federal cases, a defendant can also be held responsible for quantities connected to the conspiracy, not only what they personally sold. An attorney can help you challenge the scope of the agreement and your alleged role in it.
After a federal arrest, a judge decides whether you’ll be released while the case is pending. In many serious federal drug cases, the law presumes detention, which means the defense has to present evidence showing that conditions of release can address flight risk and safety. Preparation for this hearing matters. An attorney can help you present the strongest case for release.
It can try. Both Indiana and federal law allow the government to seek forfeiture of money and property it claims is connected to drug activity, sometimes even before a conviction. These forfeiture actions have their own deadlines and procedures, and property can often be recovered if the connection isn’t proven. An attorney can help you respond quickly and protect what’s yours.
In Indiana state court, there’s no separate trafficking offense, so large-scale cases are charged as high-level dealing. The term trafficking usually refers to large-scale distribution or federal charges like possession with intent to distribute and conspiracy. The label matters less than the drug type, the weight, and which court you’re in. An attorney can help you understand exactly what you’re charged with.
It’s generally best not to answer questions from federal agents without an attorney, even if you believe you’re only a witness. Statements to federal agents can be used against you, and lying to a federal agent is a separate crime. If you’ve been contacted or received a target letter, an attorney can help you understand your position and protect your rights before any interview.
No. Trafficking with an inmate is a separate Indiana offense that involves bringing contraband, including drugs, phones, or tobacco, into a jail or prison or delivering it to someone held there. It can be charged as a misdemeanor or felony depending on what was involved. An attorney can help you understand how this charge works and how to defend against it.

If you’re under investigation or have been charged with drug trafficking, the earliest stages of the case can affect detention, cooperation decisions, and sentencing exposure for years to come. We offer a consultation to review the charges and explain your options. Reach out to RileyCate today to speak with a drug trafficking attorney.
