Dedicated & Tenacious Litigation Lawyers in Indianapolis
A civil appeal challenges the outcome of a business dispute, a personal injury case, a family law matter, a contract disagreement, or another civil judgment that a party believes was legally wrong. Civil appeals cover the full range of civil litigation, from a jury verdict after trial to a judge’s ruling on a motion that ended the case before trial, and the strongest appeals generally focus on a specific legal error rather than simply disagreeing with the outcome.
Under Indiana Appellate Rule 9, a Notice of Appeal generally must be filed within 30 days of the trial court’s final judgment being entered on the Chronological Case Summary, or within 30 days of the ruling on a timely motion to correct error if one was filed. Documents served by mail generally receive an additional three days, and a deadline that falls on a weekend or holiday moves to the next business day, but these adjustments are narrow and shouldn’t be relied on as a substitute for prompt action. Once a Notice of Appeal is filed, the case proceeds through preparation of the record, briefing from both sides, and a decision from a three judge panel of the Indiana Court of Appeals, with a further, discretionary petition to transfer available to the Indiana Supreme Court if a party is dissatisfied with that outcome.
Civil appeals often turn on the applicable standard of review, since a legal question decided incorrectly by the trial court is generally easier to overturn than a factual finding or a discretionary ruling, which appellate courts typically give more deference. Building a strong civil appeal starts with a careful review of the trial court record to identify which issues were properly preserved and which standard of review applies to each one, since issues that weren’t raised at the trial court level generally can’t be raised for the first time on appeal.
