Dedicated & Tenacious Litigation Lawyers in Indianapolis
Robbery is one of the most serious property-related charges in Indiana because it involves taking something from another person by force or fear. Robbery covers knowingly or intentionally taking property from another person or from their presence by using or threatening force, or by putting the person in fear. It ranges from a street or store robbery to an armed robbery or carjacking, and it’s always a felony.
Robbery is a Level 5 felony at its base level, carrying one to six years in prison. It becomes a Level 3 felony, carrying three to sixteen years, when it’s committed while armed with a deadly weapon or results in bodily injury to someone other than the defendant, and a Level 2 felony, carrying ten to thirty years, when it results in serious bodily injury. Indiana also charges taking a vehicle from a person by force or threat as robbery, and federal charges may apply in some cases, like robberies of banks or businesses involved in interstate commerce. Using a firearm can also bring an additional sentencing enhancement.
Robbery cases often depend on identification and witness memory, which can be far less reliable than people assume. The defense may challenge eyewitness identifications, including how photo arrays or lineups were conducted, the quality of surveillance video, cell phone location data, and whether the evidence actually shows force or fear rather than a lesser offense like theft. In cases with more than one person involved, the state may try to hold everyone responsible as accomplices, which raises questions about each person’s actual role.
At RileyCate, we defend robbery and armed robbery charges with the trial preparation these serious felonies demand. Depending on the evidence, a case may be dismissed, reduced to theft or another lesser offense, or taken to trial. If the case involves entering a building rather than taking property from a person, our Burglary page explains how that charge works.
Robbery cases often turn on identification and witness credibility, which is exactly where attorneys with real trial experience make the difference. Will Riley and Russell Cate lead our criminal defense team. Russell Cate has more than 19 years of experience and has been selected as a Super Lawyer since 2013, and Will Riley’s Super Lawyers, Top 100 Trial Lawyers, and AV Preeminent recognition reflects the kind of trial-tested credibility that carries weight with prosecutors and judges alike.
Will and Russell personally oversee every case we take on, staffing it with the attorneys, associates, and staff the matter calls for based on its size and complexity, so you get responsive, informed representation from the outset.
