Dedicated & Tenacious Litigation Lawyers in Indianapolis
A real estate dispute can put a property, a deal, or a business relationship on hold, and the longer it takes to resolve, the more it can cost everyone involved. Real estate litigation covers disputes between businesses, property owners, developers, and other parties over commercial property, including boundary and easement disputes, breach of a purchase or sale agreement, title defects, commercial lease disputes, and disputes over who actually owns a piece of property.
Boundary and title disputes in Indiana are often resolved through a quiet title action, which asks the court to formally determine ownership or the boundary line when the parties can’t work it out on their own. Indiana law generally imposes a ten year statute of limitations on actions involving written contracts concerning real estate, with some exceptions, and a six year statute of limitations for disputes involving oral contracts, accounts, or fraud, and in many cases the clock doesn’t start running until the problem was discovered or reasonably should have been discovered. Indiana also recognizes adverse possession claims, where someone who has occupied and used a property openly, exclusively, and without the owner’s permission for at least ten years, and who paid the property taxes during that period, may be able to establish ownership, which makes these claims a serious concern for property owners who haven’t kept a close eye on how their land is being used.
At RileyCate, we handle real estate litigation for business owners, developers, and property investors, working to resolve disputes efficiently when possible and litigating aggressively when a resolution isn’t available. We handle boundary and easement disputes, breach of purchase and sale agreements, title and quiet title actions, commercial lease disputes, and adverse possession claims on both sides, whether you’re trying to protect your property or trying to establish a claim to land you’ve used and maintained for years.
Real estate disputes often move slowly until they suddenly don’t, and having attorneys who can litigate effectively the moment a deal or a property right is actually at risk makes a real difference. Will Riley and Russell Cate lead our real estate litigation team. Russell Cate is recognized as a Super Lawyer with decades of civil litigation experience, and his and Will Riley’s appellate work before the Indiana Court of Appeals and the Indiana Supreme Court gives our clients real depth in this area. Will Riley’s Super Lawyers, Top 100 Trial Lawyers, and AV Preeminent recognition reflects that same trial-tested approach.
Will and Russell personally oversee every matter we take, staffing it with the attorneys, associates, and staff the case calls for based on its size and complexity, so your dispute gets the attention its value and complexity deserve.
