A suspended license can make it impossible to get to work, take kids to school, or keep medical appointments, and for many people it’s the most immediate consequence of a traffic or criminal case. Specialized driving privileges, sometimes called a hardship license, allow a person with a suspended Indiana license to drive for specific purposes approved by a court. They cover suspensions from OWI cases, too many points, habitual traffic violator status, uninsured driving, and other court or BMV suspensions.
To get specialized driving privileges, a person files a petition with the court, and a judge decides whether to grant them and on what terms. The order can limit driving to specific purposes, like work, school, medical care, or caring for family members, and it can set times, routes, or other conditions. Courts often require an ignition interlock device in alcohol-related cases, and they can require proof of insurance. A person driving on specialized privileges has to carry the court order and follow its terms exactly, since driving outside them can lead to new charges and the loss of the privileges.
Not everyone is eligible. In particular, suspensions for refusing a chemical test after an OWI arrest generally aren’t eligible for specialized driving privileges, and some people with certain prior convictions or suspensions face additional limits. Eligibility can also depend on the type and length of the suspension and the person’s driving record. Filing the right petition, in the right court, with the right supporting information can make the difference in whether privileges are granted and how useful they are.
At RileyCate, we help clients petition for specialized driving privileges, often as part of defending the OWI, traffic, or criminal case that led to the suspension. For more on OWI cases and the license consequences that come with them, see our DUI and OWI page.
